CARAVAN OF TALENTS CAMPAIGN OFFICIAL RULES

Caravan of Talents Campaign (the “Campaign”) is a talent Campaign designed to encourage eligible youth and young adults ages 6 to 36 residing in Canadian provinces other than Quebec and in international jurisdictions whose laws permit entry (“Entrant(s)” or “You”) to enter for a chance to win a series of prizes set by Love Builder Non-profit Society in Canada. In addition to monetary prizes as described below, other potential prizes may include a chance to participate in Love Builder Non-profit Society’s virtual Cross-Canada Volunteer Tour and in-person Cross-Canada Volunteer Tour for free tour accommodations, Heart for the Arts: A Love Caravan Charity Gala 2022 attendance opportunity, and other surprise prizes, subject to Love-Builder Non-Profit Society’s budget. All prize winners will be selected by Love Builder Non-profit Society at its sole-discretion. Due to potential COVID-19 restrictions made by the Canadian government and senior communities, the Cross-Canada Volunteer Tour 2022 and Heart for the Arts: A Love Caravan Charity Gala 2022 may or may not only be held virtually.

 

REGARDING MONETARY PRIZES

As defined below, the judging of the videos will be separated into two categories: "Performance" and "Content Creation". The "Performance" category is performance-based, usually performed live on stage. The "Content Creation" category is more open-ended, often featuring creative activities, filmed in video format instead of performing live on stage. . More details regarding the categories will be provided on the Caravan of Talents landing page. Participants can also email info@lovecaravan.ca for more information. For each of these two categories there will be: one (1) Golden Winner receiving a prize of $1500 CAD cash, one (1) Silver Winner receiving a prize of $1000 CAD cash, and two (2) Bronze Winners, each receiving a prize of $750 CAD cash. All prizes, monetary and otherwise, will be awarded in accordance with these Official Rules (the “Rules”) and your participation in this Campaign constitutes full and unconditional agreement and acceptance of these Rules.

 

REGARDING OTHER POTENTIAL PRIZES

At Love Builder Non-profit Society’s sole-discretion, Love Builder Non-profit Society may award other prizes to recipients selected by Love Builder Non-profit Society at its sole-discretion, including the following: surprise prizes provided by partners and sponsors of Love Builder Non-profit Society, the opportunity to accompany certain Love Builder Non-profit Society’s performers in the Cross-Canada Volunteer Tour 2022 (with hotel, gas, and food being covered by Love Builder Non-profit Society) and/or the opportunity to attend our Heart for the Arts: A Love Caravan Charity Gala 2022 by Love Builder Non-profit Society. 

 

1. BINDING AGREEMENT

To enter the Campaign, you must agree to all of the Rules. Therefore, please read these Rules carefully prior to entry to ensure you understand and agree to them. You agree that the submission of an entry in the Campaign constitutes agreement to these Rules by the person named in the entry. You may not submit an entry to the Campaign and are not eligible to receive any of the prizes described in these Rules unless you agree to be bound by these Rules without any conditions. These Rules form a binding legal agreement between you and Love Builder Non-profit Society with respect to the Campaign. This Campaign is subject to all applicable federal, provincial and local laws and regulations and is void where prohibited by law. 

 

2. ELIGIBILITY

To be eligible to enter the Campaign, the Entrant(s) must: (a)  be within the age range from 6 - 36 years old at the time of entering the Campaign; and (b) have obtained his or her parent’s or legal guardian’s prior written permission if under the age of majority in the Province that he or she resides in. Anyone under the age of majority who enters must agree to the parent consent policy published on Caravan of Talents website  (https://www.lovecaravan.ca/caravanoftalents2022) and submit a valid written consent of a parent or legal guardian in order to be eligible to receive any prizes or otherwise participate in the Campaign. Additionally, from the time of their entry to being selected as a potential winner, all Entrant(s) under the age of majority in their Province or territory of residence must have their parent or legal guardian act in all respects of their behalf, including, without limitation, completing any declaration and release form, completing the campaign related questions as necessary and/or accepting any of the prize(s) offered. (c) agree to volunteer at least 2 senior-serving events organized by Love Builder Non-profit Society in 2022.

No purchase necessary to enter or win. This campaign is open to residents of Canada excluding the province of Quebec and is governed by applicable Canadian law. International residents may only enter this campaign if the laws of their respective jurisdiction of residence permits them to enter and any international entrants agree that love builder non-profit society will have absolutely no liability in connection with such international resident’s entry.

 

3. CAMPAIGN ORGANIZER

The Campaign is brought to you by Love Builder Non-profit Society, an independent British Columbia registered Non-Profit Organization.

 

4. CAMPAIGN PERIOD

(a)The entry period for video entries (see section 5) and Campaign begins on March 26, 2022, 12:00 am Pacific Time (PT) and ends on June 26, 2022, 11:59 pm Pacific Time (PT) (“the Entry and Campaign Period”). We will use the “First Come First Serve” rule to post the video in this period. (b)The campaign terms and conditions will be published on February 26, 2022, 12:00 pm Pacific Time (PT). The broadcasting period begins on February 26, 2022, 12:00 pm Pacific Time (PT) and ends on March 26, 2022, 11:59 pm Pacific Time (PT)  (“the Broadcasting Period”). Early video entries (see section 5) submission can be accepted in the Broadcasting period.

 

5. HOW TO ENTER

To enter the Campaign, visit the Campaign website located at www.lovecaravan.ca/caravanoftalents2022  (“Campaign Site”) during the Entry Period and follow the instructions that appear on the web-based entry form which refers to Application Form and Parental Consent Form for minors (“Entry Form”) for: (a) submitting a video that reflects Entrant’s performance and content creation talents in different art forms (“Video”); (b) completing all information on the Entry Form before submitting.

To submit an entry via email, please follow the instructions on the Campaign Site. Please note that this is the only form of entry to the Campaign available. Love Builder Non-profit Society is not responsible in any manner whatsoever for illegible or incorrectly submitted entries made via the digital upload tool.

Entries received without a fully completed Entry Form will be disqualified.

ONE (1) ENTRY LIMIT PER TALENT CATEGORY PER ENTRANT. Only ONE (1) entry per Entrant is permitted. Notwithstanding the foregoing, if you are an Entrant submitting entries for different styles of talents or different acts (for example, if you are submitting one entry as a vocalist and another as a dancer for the performance category), you may submit additional entries, each for one of your alternative/other style of talent, but you will be limited to a maximum of TWO (2) entries per categories total (i.e. in respect of 2 different styles of talent). If you submit multiple videos (to a maximum of four) the assessment of whether your videos in fact depict different styles of talent will be at Love Builder Non-profit Society’s sole-discretion. To be considered for the Campaign, entries must be: (i) complete (as determined by Love Builder Non-profit Society); (ii) received by June 26, 2022 11:59 pm Pacific Time (PT); and (iii) introduced in English. Any submission not meeting the aforementioned criteria will be disqualified, at Love Builder Non-profit Society’s sole-discretion. Love Builder Non-profit Society accepts no responsibility for submissions lost, delayed, damaged, defaced, or mislaid, however caused. All entries will be deemed made by the Entrant submitted at the time of entry. 

 

6. VIDEO REQUIREMENTS

The Video must meet the following criteria (“Video Requirements”), all to be determined in the sole discretion of Love Builder Non-profit Society:

(a) It must not be derogatory, offensive, threatening, defamatory, disparaging, libelous or contain any content that is inappropriate, indecent, sexual, profane, torturous, slanderous, discriminatory in any way, or that promotes hatred or harm against any group or person, or otherwise does not comply with the theme and spirit of the Campaign.

(b) It must not contain content, material or any element that is unlawful, or otherwise in violation of or contrary to all applicable federal, provincial, territorial, state or local laws and regulations including the laws or regulations in any province or territory or state where the Video is created.

(c) It must not contain any content, material or element that displays any advertising, slogan, logo, and trademark or otherwise indicates a sponsorship or endorsement by any commercial entity (other than Love Builder Non-profit Society) or that is not within the spirit of the Campaign. Any clothing worn in the video should not contain any visible logos, trademarks, cartoons, phrases, or third-party materials. Entrant(s) may wear clothing with Love Builder Non-profit Society’s name and/or trademarks.

(d) It must be original, unpublished work that does not contain, incorporate or otherwise use any content, music, material or element that is owned by a third party or entity or that has been submitted as part of another promotion or Campaign.

(e) It cannot contain any content, element, or material that violates a third party’s publicity, privacy or intellectual property rights.

(f) It must not have been previously submitted for any other promotion or Campaign, and must not be subject to any actual or threatened litigation or claim.

(g) IT MUST NOT BE LONGER THAN 2 MINUTES IN TRAILER STYLE. This is to give the audience a preview of the participant’s talent, so that if they wish to watch the full video, they must vote for the entry to win.

During the Campaign Period, Love Builder Non-profit Society, its agents and/or the jury selected by Love Builder Non-profit Society will be evaluating the Videos to ensure that they meet the Video Requirements. Love Builder Non-profit Society reserves the right to disqualify any Entrant(s) who submits a Video that does not meet the Video Requirements, at Love Builder Non-profit Society’s sole-discretion. Incomplete entries or entries not complying with these Rules are subject to disqualification.

 

7. JUDGING

Judging will be separated into two categories, one being based on “performance”, the other being based on “content creation”. For each category, each Video and Entry Form will be evaluated and scored based on the following “Criteria”, at Love Builder Non-profit Society’s sole-discretion:

(a) creativity and originality considering what talent performance makes Entrant(s) unique;

(b) suitability of the Entrant for the Love Builder Non-profit Society intergenerational program;

(c) adherence to the Video Requirements and these Rules; and

(d) the total number of likes associated with each video on YouTube as of June 26, 2022, 11:59 pm Pacific Time (PT) (the more likes the Entrant’s video receives, the higher the points awarded to the Entrant(s) for such Video(s)). Only one like per person/user voting will be counted, and if any likes are perceived by Love Builder Non-profit Society to have been made by bots, fake accounts or the same person operating multiple accounts, such likes will not be counted and any Entrant(s) responsible for making such likes may be disqualified, to be determined by Love Builder Non-profit Society in its sole-discretion. Without limiting the generality of the foregoing, for any Video(s) that are deemed to be “intergenerational” (at Love Builder Non-profit Society’s sole-discretion), each like will be counted twice, meaning that if such intergenerational Video receives 100 likes, the total amount of likes for the purpose of this Campaign will be considered to be 200. For the purposes of these Rules, an intergenerational Video will be one that features individuals of various ages, with an age difference of 20 years or more between the youngest and oldest individual.

The odds of winning depend on the number of entries received and the level of talent an Entrant demonstrates, the assessment of which shall be made by Love Builder Non-profit Society, at Love Builder Non-profit Society’s sole-discretion, based on Love Builder Non-profit Society’s requirements and preferences.

Using the Criteria, Love Builder Non-profit Society will choose one (1) Golden winner, one (1) Silver winner and two (2) Bronze winners, at its sole-discretion for each of the two categories described above. 

 

8. NOTIFICATION OF GOLDEN, SILVER, BRONZE WINNERS

Notification: Golden, Silver, Bronze winners will be notified on or before July 1, 2022 by email and/or telephone.

Tie-breaker: In the event of a tie at any stage, Love Builder Non-profit Society will re-evaluate the Entrants according to the Criteria and select a winner, at its sole-discretion.

All decisions/evaluations by Love Builder Non-profit Society are final and binding. In the event that there are not enough eligible entries, not all prizes will be awarded. If a potential winner is unable for whatever reason to accept his or her prize, then Love Builder Non-profit Society reserves the right to award the prize to the next suitable Entrant or to no other person at all, at its sole-discretion.

Becoming a Golden, Silver or Bronze winner is subject to validation and verification of eligibility and compliance with all the terms and conditions set forth in these Rules. If a potential Golden, Silver or Bronze winner is disqualified for any reason, the Video that received the next highest total like will be chosen as the potential Golden, Silver or Bronze winner, if applicable. With respect to notification by telephone or live streaming online meeting call, such notification will be deemed given when the potential Golden, Silver or Bronze winner, or their parent or guardian,  engages in a live conversation with Love Builder Non-profit Society or a representative of Love Builder Non-profit Society or when a message is left on the potential Golden, Silver or Bronze winner’s voicemail service or answering machine by Love Builder Non-profit Society or its representative, whichever occurs first. Each potential Golden, Silver or Bronze winner and parent/legal guardian may be required to sign and return a declaration and release from and provide any additional information that may be required to Love Builder Non-profit Society (all decisions to be made solely by Love Builder Non-profit Society at its sole-discretion). If required, potential Golden, Silver or Bronze winner(s) must provide all such required documents via email (or as otherwise instructed) within 7 days following attempted notification by Love Builder Non-profit Society as set out above, otherwise such potential Golden, Silver or Bronze winner(s) will be deemed to have forfeited the opportunity to win a prize and another potential Golden, Silver or Bronze winner may be selected based on the judging Criteria described herein, or any other criteria of Love Builder Non-profit Society. In the event the potential Golden, Silver or Bronze winner is a minor, his or her parent or legal guardian must sign the documents and return them as described herein. All notification requirements, as well as other requirements within these Rules, will be strictly enforced. If any potential Golden, Silver or Bronze winner does not respond to any notification attempt by Love Builder Non-profit Society for any reason within three (3) days from the first such notification attempt, then such potential Golden, Silver or Bronze winner may be disqualified and an alternate potential Golden, Silver or Bronze winner may be selected from among all eligible entries received based on the judging Criteria described herein, or as otherwise determined by Love Builder Non-profit Society.

 

9. GENERAL CONDITIONS

All applicable federal, provincial, territorial, municipal, and other local laws and regulations apply. Love Builder Non-profit Society reserves the right to disqualify any Entrant(s) from the Campaign if it reasonably believes that the Entrant(s) has attempted to undermine the legitimate operation of the Campaign by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other Entrant(s), Love Builder Non-profit Society, or anyone else.

 

10. PRIZES

The following prizes are available to be won for each of the two categories, as described above:

  • One (1) Golden Prize ($1500 CAD)(defined above)

  • One (1) Silver Prize ($1000 CAD)(defined above)

  • Two (2) Bronze Prizes ($750 CAD)(defined above)

Love Builder Non-profit Society reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason whatsoever, and may also change any of the dates mentioned in these Rules at any time.

 

11. INTELLECTUAL PROPERTY RIGHTS

Entrant(s) represent and warrant that their Videos are their own original work and, as such, they are the sole and exclusive owner and rights holder of the submitted Video and that they have the right to submit the Video in the Campaign and grant all rights required by Love Builder Non-profit Society to use the Video in any lawful manner that it chooses without any restrictions or requirement to obtain any third party’s consent or permission, as described more fully below. In addition to the requirements set out in Section 6, each Entrant agrees not to submit any Video that: (a) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; or (b) otherwise violates applicable provincial, state, territorial federal, or local law. All Entrants agree that Love Builder Non-profit Society will in no way whatsoever be liable for any infringing materials that may be included in any Video submitted, and in the event that Love Builder Non-profit Society suffers any type of loss or is the subject of an infringement claim in connection with any Video, the Entrant that submitted such Video agrees to fully indemnify Love Builder Non-profit Society for any and all losses incurred.

As between Love Builder Non-profit Society and the Entrant, the Entrant agrees to transfer ownership of all intellectual and industrial property rights in and to the Video (excluding Love Builder Non-profit Society’s rights in the Love Builder Non-profit Society logo/trademark or any other intellectual rights owned by Love Builder Non-profit Society). Further, each Entrant hereby waives any and all privacy, publicity and/or other personality rights (including relating to defamation) in favour of Love Builder Non-profit Society and represents and warrants that each and every individual that is recognizable in any Video has also waived all such rights in favour of the Entrant and Love Builder Non-profit Society. Love Builder Non-profit Society reserves the right to publish the name and likeness of the Golden, Silver or Bronze winners on the Campaign Site or through other media for publicity purposes. As a condition of entry, Entrant transfers and assigns to Love Builder Non-profit Society any and all right and title such Entrant has in and to any submitted Video, including, without limitation, the right to use, reproduce, adapt, modify, publish, distribute, publicly perform, create a derivative work from, and publicly display the Video(s) for any purpose, including display on the Love Builder Non-profit Society website, without any attribution or compensation to Entrant (other than announcing the Entrant as a winner, if applicable). The Video(s) may also be used by Love Builder Non-profit Society for press and media purposes and Entrant agrees to waive any rights, including moral rights, and not assert any intellectual property rights against Love Builder Non-profit Society that Entrant has or may have in the Video. Entries and/or Videos will not be returned. Entrants understand and acknowledge that Love Builder Non-profit Society may use the Videos for promotional purposes and any other purposes that Love Builder Non-profit Society sees fit.

 

12. PRIVACY

data submitted with an entry, including name, mailing address, phone number, and email. Entrants agree that personal addresses may be collected, processed, stored and otherwise used by Love Builder Non-profit Society and its affiliates for the purposes of conducting and administering the Campaign. By entering the Campaign, Entrants agree to the transmission, processing, disclosing and storage of this personal data by Love Builder Non-profit Society and its affiliates. All personal information that is collected from the Entrant is subject to Love Builder Non-profit Society’ Privacy Policy, located at: www.lovecaravan.ca/privacy. Entrants have the right to access, review, rectify or cancel any personal data held by Love Builder Non-profit Society in connection with the Campaign by scanning a written letter and email to Love Builder Non-profit Society at the following email address: info@lovecaravan.ca. If an Entrant does not provide the data required at entry, that Entrant’s entry may be ineligible.

Without limiting the generality of the above, Love Builder Non-profit Society does not knowingly collect Information from individuals under the age of majority in the jurisdiction of their residence (“Minor”) without the consent of their parent or legal guardian. Accordingly, all submissions of Entries or other information to Love Builder Non-profit Society are restricted to persons who are the age of majority in the jurisdiction of their residence. Notwithstanding the foregoing, if you are a Minor and have the consent of your parent or legal guardian to submit your information to Love Builder Non-profit Society, you may submit such information to Love Builder Non-profit Society only with the involvement of a parent of legal guardian who agrees to these Rules and to be responsible for your participation in the Campaign. IF YOU ARE A MINOR, DO NOT SUBMIT AN ENTRY TO LOVE BUILDER NON-PROFIT SOCIETY UNLESS YOU HAVE THE CONSENT AND INVOLVEMENT OF YOUR PARENT OR LEGAL GUARDIAN. Until you are the age of majority in your jurisdiction of residence, your parents or legal guardians may ask us to modify, deny access to, or delete your entry and we may do so at their request at any time, for any reason, without notice or liability. To submit information to Love Builder Non-profit Society, Love Builder Non-profit Society may require that the parents or legal guardians of Minors enter into a separate agreement to evidence the consent of the parent or legal guardian. If Love Builder Non-profit Society becomes aware that it has collected information from Minors without verification of parental consent, Love Builder Non-profit Society will discard and delete said Information. 

 

13. PUBLICITY

By entering the Campaign, Entrants agree to participate in any media or promotional activity(ies) resulting from the Campaign as reasonably requested by Love Builder Non-profit Society and agree and consent to use of their name and/or likeness by Love Builder Non-profit Society. Love Builder Non-profit Society will contact Entrants in advance of any Love Builder Non-profit Society sponsored media requests for interviews. 

 

14. ELIMINATION

 In addition to any other events provided in these Rules which can lead to immediate elimination or disqualification of Entrant(s) by Love Builder Non-profit Society, any false information provided within the context of the Campaign by Entrant(s) concerning identity, mailing address, telephone number, email address, ownership of right or noncompliance with these Rules or the like may result in the immediate elimination of the entrant from the Campaign. 

 

15. INTERNET AND DISCLAIMER

Love Builder Non-profit Society is not responsible for any malfunction of the entire campaign site or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed videos or entry forms due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the internet or at the campaign site, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit entrant’s/consumer’s ability to participate/vote respectively. Love Builder Non-profit Society is not responsible for the policies, actions, or inactions of others, which might prevent entrants from entering, participating, and/or claiming a prize in this campaign. Love Builder Non-profit Society’s failure to enforce any term of these rules will not constitute a waiver of that or any other provision. Love Builder Non-profit Society reserves the right to disqualify Entrants who violate the rules or interfere with this campaign in any manner. If an entrant is disqualified, Love Builder Non-profit Society reserves the right to terminate that Entrant’s eligibility to participate in the campaign.

 

16. RIGHT TO CANCEL, MODIFY OR DISQUALIFY

If for any reason the Campaign is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Campaign, Love Builder Non-profit Society reserves the right to cancel, terminate, modify or suspend the Campaign and Campaign terms and conditions. Such cancellations, terminations, modifications, or suspension will be notified by posting on Love Caravan’s website at www.lovecaravan.ca (“Website”) or in any other manner as Love Builder Non-profit society deems fit. Love Builder Non-profit Society further reserves the right to disqualify any Entrant who tampers with the submission process or any other part of the Campaign or Campaign Site. Any attempt by an Entrant to deliberately damage any web site, including the Campaign Site, or undermine the legitimate operation of the Campaign is a violation of criminal and civil laws and should such an attempt be made, Love Builder Non-profit Society reserves the right to seek damages from any such Entrant to the fullest extent of the applicable law. 

Love Builder Non-profit Society has the right of final interpretation of the Campaign and Campaign Terms and conditions.  

 

17. FORUM AND RECOURSE TO JUDICIAL PROCEDURES

These Rules shall be governed by, subject to, and construed in accordance with the laws of British Columbia and Canada, excluding all conflict of law rules. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Campaign are hereby excluded, and Entrants expressly waive any and all such rights.

 

18. LIST OF WINNERS

For a complete list of winners, send a self-addressed stamped envelope to Love Builder Non-profit Society. All requests must be received no later than June 31, 2022.
